Pos Service Warranty
1. Introduction
1.1. These Terms and Conditions ("T&Cs") which governs the ("Service Warranty") provided for the Articles shipped through Pos Malaysia Berhad's (Registration No.: 199101019653 (229990-M)) ("Pos Malaysia") courier service, are entered into between yourself and Pos Malaysia.
1.2. By purchasing Service Warranty, you (the "Customer") agree and acknowledge to comply with and be bound by these T&Cs. These T&Cs may be updated by Pos Malaysia from time to time without prior notice to you and such updated T&Cs shall be binding upon you in respect to Service Warranty, as from the date specified by Pos Malaysia or such date as the T&Cs shall take effect, whichever is the earlier.
1.3. This Service Warranty is also subject to Pos Malaysia's General Terms & Conditions ("GTC") accessible at https://www.pos.com.my/legal/terms-and-conditions-general. In the event of any inconsistency or conflict between the GTC and these T&Cs, these T&Cs shall take precedence over the GTC.
2. Article
2.1. "Article" means a letter, a package, a parcel, a wrapper or a container that can be collected, transmitted and delivered through the network of Pos Malaysia.
3. Service Warranty
3.1. Definition: The Service Warranty is an optional service designed to enhance the handling and care of your parcel during transit. The service fee covers additional logistical support and operational safeguards to minimize the risk of loss or damage.
3.2. Non-Insurance Disclaimer: This service is not an insurance policy under the Financial Services Act 2013 and is not regulated by Bank Negara Malaysia. By purchasing this service, you acknowledge and agree that it is a value-added logistics solution, not an insurance product.
3.3. Scope of Warranty: If your parcel is lost or damaged during transit, we will assess claims on a case-by-case basis. If a claim is approved, we may, at our sole discretion:
- Replace the item with an identical or equivalent product, or
- Reimburse you for the declared value of the lost parcel or cost of damage, up to a maximum of RM5,000, whichever is lower.
3.4. Duration of Warranty The warranty begins when Pos Malaysia accepts the Article for delivery (commencement date) and ends upon delivery to the recipient. Claims for lost parcels must be made within 30 days from the date commencement, while claims for damaged parcels must be made within 5 working days from the date of delivery.
3.5. Exclusions
3.5.1 Excluded Items
The following items are not covered under the scope of Service Warranty:
- Cash and Financial Instruments: Including money, checks, gift cards, vouchers, and any other negotiable instruments.
- Dangerous Goods & Prohibited Items. Dangerous Goods and/or prohibited items under any relevant written laws, rules, regulations or guidelines by the relevant authorities in Malaysia or destination countries. “Dangerous Goods” shall be as defined by International Air Transport Association (“IATA”), the International Air Transport Association Dangerous Goods Regulations (DGR) and International Civil Aviation Organization (ICAO) and Civil Aviation Act 1969 (which includes any amendments, updates or supplements that may be issued from time to time) and “Prohibited Items” shall mean any goods and/or Article that are prohibited by the laws, regulations and/or authority of the country of origin and/or country of destination. - Pre-existing Damage: Articles already damaged before shipping.
- Perishable Goods: items that spoil or decay over time, such as fresh produce, dairy, seafood, meats, pharmaceuticals, frozen items, and flowers.
- Expensive Items including jewellery, luxurious watches, antiques, and precious metal and stones.
- Fragile Items: Items requiring special handling, including scale models, terrariums, and prototypes.

3.5.2 Warranty Exclusions
The warranty does not cover:
- Loss or damage caused by natural disasters or circumstances beyond Pos Malaysia's control.
- Wilful misconduct or gross negligence by the Customer.
- Inadequate or unsuitable packaging.
- Loss, damage, or expense caused by delay.
3.6. Limited Warranty:
The warranty for the following items shall be limited to RM1,000 per Article:
- Fragile Articles which are easily broken or damaged.
- Liquid or Non-solid Articles of any kind including water, alcohol, gels, creams, aftershaves, perfumes, skincare products, detergents, ready-to-eat foods, and powders for either delivery within Peninsular Malaysia, within Sabah or within Sarawak.
Engaging or indulging in any conduct in breach of these rules of conduct is ground for us to suspend or terminate your use of our Services and/or access and use of our platform. If we receive a complaint, you must respond to our queries immediately with full disclosure.
4. Customer's Obligations
4.1. Accurate Declaration: You agree and acknowledge that you must declare the correct and accurate value of the Article at the time of shipping.
4.2. Under-Declaration: In the event of any under-declaration of the value of the Article, the warranty shall be limited to the value declared by the Customer.
4.3. The Article shall be properly and securely packed and wrapped to prevent damage in the course of conveyance.
4.4. You agree and acknowledge that you must take the necessary reasonable measures to mitigate further loss/ worsening of the situation. If temporary repairs are required to stop further damage, you should ensure that these are carried out immediately and the bills for the works done should be kept as part of your claim. If the repairs required are of a permanent nature, you should obtain estimates of the repairs required and send them to us or our surveyors/adjusters for verification or approval.
5. Claims Process
5.1. Claims must be submitted in accordance with Pos Malaysia’s General Terms and Conditions in effect on the submission date.
6. Packaging Guideline
6.1. General Packaging Requirements:
We use cookies on the Platform which record information including browsing history and pattern, Internet log information and visitor behaviour. A cookie file is stored in your web browser and allows a third-party to recognize you. We use cookies for the following purposes:
- Sturdy Materials: Use strong and durable materials appropriate for the weight and nature of the item.
- Secure Sealing: Seal parcels securely to prevent accidental opening during transit.
- Clear Labelling: Clearly write or print the recipient's and sender's full names and addresses on the parcel.
- Fragile Items: Clearly label items as "Fragile" and use adequate cushioning materials, such as bubble wrap, to protect them.
7. Purchasing Terms for Service Warranty
7.1. Payment Terms: Payment for Pos Service Warranty must be paid in full at the time of purchase.
7.2. Non-Refundable Payment: Except for Pos Service Warranty purchased for Articles set out in Section 3.5.1 of these T&Cs (Excluded Items), payment paid for Pos Service Warranty are not refundable.
7.3. Refundable Exclusion: If your Article is provided under Excluded Items as set out in Section 3.5.1 of these T&Cs (Excluded Items), you will be entitled to a refund of the payment for Service Warranty if you have paid upfront for such protection.
8. Limitation of Liability
8.1. Liability Limit: Pos Malaysia's liability is limited to the declared value of the Article, or the maximum warranty limit as set out in Section 3.3 and 3.6 of these T&Cs, as applicable, whichever lower. Any partial damage or partial loss to the Article, shall be compensated partially. Final compensation amount is determined by Pos Malaysia at its sole discretion.
8.2. Consequential Damages: Pos Malaysia shall not be liable to you for any loss of income, loss of profits, loss of markets, loss of reputation, loss of customers, loss of use, loss of an opportunity, any incidental, special, punitive, exemplary and consequential damages or loss howsoever arising including without limitation breach of contract, negligence, wilful act, any claims for delay or loss or destruction resulting from the loss or damage to the Article.
